Consent to Receive Electronic Communications

PLEASE READ THIS NOTICE CAREFULLY AND KEEP A COPY FOR YOUR RECORDS.

This Consent to Receive Electronic Communications ("E-Consent"), applies to all Communications for those products, services and Accounts offered, operated or made available by or accessible through the Henry Website, Virtual Assistant, mobile application or mobile website, and any associated system (the “Site”) (collectively, “HenryServices”).

The words "we," "us," and "our" refer to (i) Henry Homes, Inc. (“Henry”), which provides and coordinates your home maintenance services, and (ii) the professional services entities Henry may engage at your request to perform specialized coordinated care services for your home. The words "you" and "your" mean you, the individual identified on the Account. As used in this E-Consent, "Account" means the account(s) you have with or through us now or in the future, including ones that you open online through the Henry Site. "Communication" means any client agreement, service orders, your home assessment Report, monthly billing statements, disclosures, notices, privacy policies and all other communications and information related to Henry Services or your Account, including information we are legally required to provide you in writing. "Virtual Assistant" means the Henry artificial intelligence driven platform and any associated system.
1. Communications to Be Provided in Electronic Form
You agree that we may provide to you the following types of Communications electronically: 

Monthly, annual or other billing statements or notices detailing activity in your Account, all notices and disclosures that accompany or are contained in billing statements, including information we may be required to provide to you in writing under applicable laws or regulations or by various agreements we may have with you (e.g., privacy notices); and any other information relating to the Services we provide, including but not limited to special notices concerning activity in your Account, agreements governing and required disclosures related to any new Account, notices of changes in the terms governing your Account, and notices of any changes in the terms of this E-Consent.
2. Method of Providing Communications to You in Electronic Form
All Communications we provide to you electronically will be through any of the following methods, which we may select at our discretion: 

To an email address you have provided to us, or by sending a message to that email address with a link through which you may log in to your Henry Account and view the Communications; to the extent permissible by law, by access to a website, including our mobile websites, Virtual Assistant or applications, that we will generally designate in advance for such purposeby posting a notice in your Henry online Account, directing you to the location where you may find the Communications; by sending the Communications to a wireless device you have designated; or by any other electronic means we have agreed upon with you.

Any one of the above methods of communication may include us requesting you download a PDF file containing the Communication.You agree that delivery of Communications by any of the above methods will comply with any legal, regulatory or contractual requirements that we send you the Communications “in writing,” and that the electronic versions of any such Communications will have the same legal effect as if they were provided in paper form. Even if you have consented to receive electronic Communications, in our discretion we may from time to time send paper copies of certain Communications to the mailing address of record we have on file for the applicable Account, either in addition to or in lieu of providing electronic versions. 

This E-Consent applies only to Communications you receive from us. Any notices or communications which you are required to send to us in writing, whether pursuant to our agreements with you or under applicable law, must still be mailed in paper form to the applicable address we have provided to you, unless (i) our agreements expressly state that we will accept a particular type of notice or communication through an alternate method, or (ii) we have separately agreed with you to accept delivery through an alternate method. 
3. Update Your Records
You agree to provide us with your current email address and to promptly notify us of any changes to your email address by sending us a message to support@henryhomes.com. Similarly, for delivery to wireless devices, you must provide us a phone number for that purpose and keep it updated. If you give us an incorrect email address or phone number or fail to keep either updated, you agree that any Communications we may make available or attempt to send through any of the methods described above will be deemed to have been provided to you in a timely manner.
4. Requesting Former Communications
Communications that we make available through the Virtual Assistant will remain accessible for a period of time which we may establish at our discretion and which may vary with the type of Communication. After that, mailed paper copies of former Communications generally may be available upon request, for a period of time we establish at our discretion, by sending us a message to support@henryhomes.com. We may charge you a fee for mailing paper copies of past Communications; the amount of the fee will either be disclosed before we fulfill your request.
5. Hardware Requirements
To access, view and retain Communications electronically, you must have an updated computer or other device with internet access and a compatible web browser.. Compatible browsers include the most current version (and typically one or more prior versions) of all major browsers in widespread use. You will also need a valid email address and access to a printer or the local electronic storage capacity to download information to keep copies for your records. 

When you agree to this E-Consent, you are acknowledging that you have the capability to access Communications electronically and to download or print copies for your records.

6. How to Withdraw Consent to Marketing Communications
You may withdraw your consent to receive marketing Communications electronically at any time by sending an email to support@henryhomes.com with subject line “Marketing Opt-Out”. If you do this, we will need a reasonable time to implement the change, and you will continue to receive Communications electronically until the change takes effect. We may, but are not required to, treat an invalid email address as a withdrawal of your consent to receive electronic Communications.
7. Federal Law
You acknowledge and agree that your consent to electronic Communications is being provided in connection with a transaction affecting interstate commerce that is subject to the federal Electronic Signatures in Global and National Commerce Act (the "Act"), and that you and we both intend that the Act apply to the fullest extent possible to validate our ability to conduct business with you by electronic means.
8. Termination and Changes
This E-Consent does not automatically expire and is not limited in duration. We reserve the right, in our sole discretion, to discontinue providing electronic Communications, or to terminate or change the terms and conditions on which we provide electronic Communications. We will notify you of any such termination or change as required by law.
9. Consent and Acceptance 
When you acknowledge your agreement to this E-Consent, you are confirming that you have read, understand and agree to be bound by the terms and conditions described above; consent to receive electronic Communications according to the process described above; and understand that you may incur costs, including but not limited to charges from your internet service provider, in accessing and/or viewing such document(s).
