Privacy Policy

Henry Homes, Inc. respects your privacy and is committed to protecting your personally identifiable information, including information that identifies, relates to, or is capable of being associated with a particular individual or household (“PII”), that may be collected through your use of our websites, Virtual Assistant, mobile applications and/or any related system (together, “Site”), or when you interact with us online or offline/on-site regarding products or services available through Henry (“Services”). This privacy policy (“Policy”) describes how we collect and use your PII and how you can control that use.

This Privacy Policy covers data shared with Henry, its affiliates and subsidiaries, including Henry Home Services, Inc. (collectively, “Henry”).

Please read this Policy carefully. By using our Site or Services, you agree to our collection, use, and sharing of your PII as described in this Policy.

Note: Henry does not sell your data. More specifically, Henry has not and will not sell your PII to third parties for business or commercial purposes. Because such sales do not occur, there is no process to opt-out of such activity.
Personal Information We Collect
Through your use of our Site and Services, we may collect PII to provide better services to our customers and other visitors to or users of our Site.

The below describes the types of information we may collect:

Personal Identifiers: Information that can be used to identify you, such as your name, address, contact information, IP address, username, email address, phone number, or other unique personal identifiers such as cookies and beacons. We may also collect PII about you from third-party sources and combine it with the information you provide to us.

Other Types of Personal Information: If you use our Site, we may ask for your permission to access certain information and features on your device, including your camera and photos.

If you contact us, ask questions, share comments or suggestions, or otherwise provide us with information about yourself, we will maintain records of your correspondence. We also may maintain the email addresses of and personal messages sent to individuals you identify if you choose to participate in any applicable referral program.

For certain Services we offer, you may decide to provide us with additional personal information, including information such as your partner’s name, phone number and email, and bank or financial account information for payment purposes.

If you provide us with access to third-party sites on your behalf, we will be able to access your personal information maintained by such third-party sites.

Commercial Information: Records of personal property, products or services purchased or considered, and consuming tendencies such as property maintenance information.

Internet or Other Similar Network Activity: Information regarding your interaction with our applications, such as which of our web pages you access, the frequency of access, and what you click on while on our Site.

Device Information: Information about the device you are using such as: hardware model, operating system, application version number, browser, and IP addresses.

Mobile Device Information: In addition to the device Information listed above, when you access our Site or Services via a browser on your mobile device or through amobile application, we may also collect mobile network information including phone number, the unique device identifier assigned to that device, mobile carrier, operating system, and other device attributes.

Geolocation Information: Information about your actual physical location which may be determined from your IP address and other sensors that may reveal information on nearby devices, Wi-Fi access points, and cell towers. Certain features of the Services available through our Site may not be available if you do not enable this collection.

Sensory Data: Audio information, such as voicemails or calls recorded for quality assurance purposes.

Inferences Drawn From Other Personal Information: Profile reflecting a person's preferences or tendencies.

Sensitive Personal Information: Account login information

Deidentified and Aggregate Information is statistical or aggregated information that does not directly identify a specific person, but it may be derived from your PII. This may include PII from which we remove identifiers to create de-identified information that does not identify a specific person.

PII does not include publicly available information or Deidentified or Aggregate information.
From Whom We Collect Personal Information
We obtain the categories of PII listed above from the following categories of sources:

- You or your agents, directly or indirectly. For example, from forms that you provide to us related to the goods and services we provide you, or from information we collect through your interactions with us.

- Our websites and related applications that may track your activity.

- Internet service providers and social media networks.

- Data analytics providers.

- Joint marketing partners who perform activities at the direction of Henry.

- Affiliates and vendors that interact with us in connection with the Services we perform.

- Government agencies from which public records are obtained.
How We Use and Share Personal Information
We may collect, use and/or share the categories of PII listed above, in accordance with applicable laws, regulations, and this Policy, to operate or improve our business, such as in the following ways:

Providing You Henry Services: We use PII to fulfill requests you submit to us or through us.

Communicate: We use PII to communicate with you about our Site, our Services, and products and services offered through the Site. This may include marketing or notification of important changes to our Site and Services. These communications may be delivered through push notifications if you have enabled that feature, or by phone call, text message, or email message.

Operating Henry’s Business: We may use your PII to manage, maintain, and develop plans for our Services; support our business functions; improve our products and services; conduct testing, research, and analysis for technological and product development; maintain systems security and detecting and prosecuting security incidents; detect and address system performance issues; manage vendor relationships with vendors; evaluate or conduct a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of our assets, whether as an ongoing concern or as part of bankruptcy, liquidation, or similar proceeding, in which personal information held by us is among the assets transferred.

Specific Purposes: You may be asked to provide information for a specific purpose. For example, if you participate in a future potential Henry referral program, you will be asked for information about your referral.

Performing Marketing Activities: We may use PII to notify you about available products and services offered by Henry or other third parties; administer promotional offers or contests that you participate in; provide personalized ads and web content; conduct market; and create provide analytic services and/or enable certain vendors to provide similar services on behalf of Henry.

Providing Third Party Services: We will use PII to enable vendors, on our behalf, and/or unaffiliated third-party service professionals to provide you or your household the Services you request or may be interested in (for example, roof, HVAC, or home/appliance repairs).

Customer Support: We may use your PII to provide you support or other services you have ordered from us. For example, we may need your information in order to provide technical support.

Feedback: If you choose to tell us your story, provide feedback or endorsement, or otherwise give a testimonial, we will review such information and may post that information on our Site or in other business materials, along with your name, city and state, and any other PII that you choose to disclose. By sharing your opinion, you consent to us posting any information and content, including images and video content, you provide on our Site. If you submit or share your opinion, you may revoke such consent at any time by contacting us at support@henryhomes.com.

Site Maintenance and Improvements: We analyze how our users interact with our Site and Services in order to maintain, train, and improve our Site and Services, including artificial intelligence development. We also use information that we collect to diagnose any problems with our Site or Services to improve the user experience.

Fulfilling Legal Duties: We may use your PII when cooperating with governmental/ regulatory authorities, and state tax collection authorities; responding to law enforcement requests; complying with an applicable law, court order, commission request, or request from other state or federal governmental agencies with legal authority to obtain such personal information; and/or taking action when the company has formed a good-faith belief that disclosure of information is necessary to protect the rights and property of Henry, and/or its affiliates or its customers.

We also may collect, use or share your PII for other reasons. In such an instance, the use or sharing of the PII will be described to you upon collection of it.
With Whom We Share Personal Information
Henry respects the privacy of your information and aims to limit its disclosure; however, we may share PII with third parties in certain circumstances and in accordance with applicable laws and restrictions as described below:

Affiliates: We may share PII with our parent company Henry Home Services, Inc., our affiliates, joint ventures, or other companies under common control with us.

Service Providers: Affiliates, agencies and/or vendors that interact with us in connection with the goods we offer and the services we perform, including non-affiliated vendors or agencies, such as subcontractors providing requested goods and services, marketing firms, customer survey administrators, third-party service professionals, and business analytics partners (collectively with Affiliates, “Henry Parties”).

Other Third Parties with Your Consent: Third parties to whom you or your agents authorize us to disclose your PII. Henry is not responsible for any consequences of any use of disclosure of your PII by you or any third party with whom you share your PII.

Regulators and Governmental Authorities: We will share PII where we are legally required to do so, such as in response to court orders or legal process, to establish, protect, or exercise our legal rights, to defend against legal claims or demands, or to comply with requirements of mandatory applicable law.

Corporate Structure: We may share PII in connection with a merger, acquisition, consolidation, change of control, or sale of all or a portion of our assets or if we undergo bankruptcy or liquidation.

To Prevent Harm: We may share PII if we believe it is necessary in order to detect, investigate, prevent, or take action against illegal activities, fraud, or situations involving potential threats to the rights, property, or personal safety of any person.

Anonymously: We may share PII in a manner that does not identify you. For example, we may share anonymous and/or aggregate information about your use of our Site, services offered through our Site, and products at our discretion.

Public Forums: Some parts of the Site may allow you to participate in public forums (such as chat rooms, forums, listservs and message boards) or interact with other users. When you participate in these features, the information that you provide, including any PII, will be available to other Site users and/or the general public. You are responsible for the content you share in those sites and the consequences of those posting. 

Where permitted by law, we may share PII for other reasons we may describe to you at the time of collection or sharing.

When we share PII with others, Henry implements reasonable contractual protections to limit third party use of your PII. Henry does not sell PII for monetary consideration.

Correcting and Updating PII

If your PII changes, you may correct or update certain PII by contacting us at: support@henryhomes.com. If you have a Henry subscription and your account is in good standing, you may also correct or update certain PII by signing into your account on our Site and updating your information there.
Online Advertising
Marketing, Analytics and Other Purposes

Some content on the Site may be provided by third parties, including advertisers, ad networks and servers, analytics companies, and application providers. The information collected may be used for internet-based advertising more relevant to you based on data collected on our Site and other online properties over time or non-advertising purposes, such as to improve customer experience when you use our Site. These third parties may collect personal information, including PII, or information related to PII about your online activities over time and across different websites or online services, including cookies and beacons, including via cookies, web beacons, pixels or similar other technologies. These third parties have their own privacy policies that govern how they process information about you.
Security of Your Personal Information
Protecting your PII is a top priority for us. We maintain physical, technical, and administrative security measures to protect and limit access to your PII. However, while we strive to use commercially reasonable means to protect your PII, no information can be guaranteed to be 100 percent secure.

Third-Party Websites and Tools

The Henry Site may contain links to or from third-party sites that are not owned or controlled by Henry, its parent company or affiliates. For example, they  may include integrated social media tools or “plug-ins,” such as social networking tools offered by third parties. If you use these tools to share PII or you otherwise interact with social media features on the Service, those social media companies may collect information about you and may use and share such information in accordance with your account settings, including by sharing such information with the general public.We do not monitor or control, and are therefore not responsible for, the privacy practices or the content of linked third-party websites or tools. You are subject to the policies of those third parties where applicable. We recommend reviewing the privacy policies for any linked websites you visit.
Protection of Children’s Privacy Online
Our  and Services are not intended for use by children. As such, Henry does not knowingly solicit or collect any information from children under the age of 18 years. If we become aware that a child under 18 has provided us with PII and is not covered by a legal exception, we delete the PII provided by the child in accordance with applicable laws. If you become aware that a child under the age of 18 may have provided us with personal information without a parent or guardian’s consent, please contact us as specified below in the “Contact Us” section of this Privacy Policy.
Virginia Privacy Rights
This section contains disclosures required by the Virginia Consumer Data Privacy Act (“VCDPA”), and applies only to PII that is subject to the VCDPA, as applicable. Certain of the information that Henry collects is exempt from the VCDPA because it cannot be associated with a particular consumer or household. This section sets forth Henry’s practices, and your rights, as applicable, regarding non-exempt PII that Henry collects, which may vary depending on how you have interacted with Henry, including the Henry Services you have obtained.

Your Rights Regarding Personal Information

Virginia residents have certain rights with respect to the PII collected by businesses, unless such information is exempt from the VCDPA.

With respect to the right to opt-out of sales of PII, Henry does not and will not sell PII about you that is subject to the VCDPA. If you are a Virginia resident, you may have the following rights with Henry regarding your PII, subject to certain exceptions and limitations:

- The right to know, obtain, access, delete, and correct PII we collect.
- The right to restrict the use of your PII for targeted advertising.
- The right to control our use of sensitive personal information - express consent is required to process sensitive data.
- The right not to receive discriminatory treatment for the exercise of the privacy rights conferred by the VCDPA.
- The right to appeal a denial of a consumer rights’ request.

Upon submission of an eligible request, Virginia consumers will receive a response within 45 days (unless an extension of up to 45 additional days is needed upon which the consumer will receive notice and an explanation for the extension).

Please keep in mind that federal and state legal exemptions may apply to these requests. For example, Henry cannot delete data provided by a client to service an active (or recently active) account, if such data is still needed to provide the product or service and/or meet legal retention requirements.

Verification Process and Required Information

We may need to request additional information from you to verify your identity or understand the scope of your request, although you will not be required to create an account with us to submit a request or have it fulfilled. At a minimum, we will require you to provide your name, email address and state of residence. Information submitted for verification purposes will only be used to verify the requestor’s identity and/or authority to make a request on another’s behalf.

Authorized Agent. You may designate an authorized agent to make a VCDPA request on your behalf by completing the Privacy Request Form and also submitting the Authorized Agent Designation.

Applicable Law
This Site is controlled, operated, and administered by Henry from its offices within the United States. As such, the Site and Policy are provided in accordance with and subject to the applicable laws of the United States and the state(s) in which we operate. You will see additional state-specific terms that only apply to customers located in that state(s), or as required by applicable law. If you are accessing this Site from a location outside the United States or a state in which we operate, you agree that your use of this Site and our collection and use of your PII is subject to this Policy.
Updates to this Policy
We reserve the right to modify, expand, or update this Policy at any time as we deem appropriate, so please review it periodically. If we decide to make changes to this Policy, we will post those changes to this Site in a manner that is conspicuous and appropriate and update the Policy’s “Effective Date” identified at the bottom of this page so you remain aware of what information we collect, how we use it, and under what circumstances, if any, we disclose it. You agree to these future updates by continuing to use our Site or Services after they have been posted. You should stop using our Site and Services if you do not agree with our Policy.
